Law 2018, NF525 certification: beauty salon, hair salon, spa, home hairdresser... who is concerned?

On January 1, 2018, only hair salons and beauty salons that are already computerized will be affected.

If you are not computerised, i.e. you do not use any computer software to manage your receipts and accounts (such as Excel), you will have no obligations to comply with. Similarly, if you are a self-employed entrepreneur 😉

If, for example, you are a home-based hairdresser and your turnover does not exceed €32,900 per year, you will not be subject to this law. In another case, if your hairdressing salon is not computerised and you record the payments manually in a notebook, you will not be obliged to equip yourself. However, you will have to comply with some of the rules set out in paragraph 3 of Article 286 of the CGI, such as the use of a book with numbered pages in which you will enter, day by day, the amount of each transaction without any blanks or erasures. Why was this software certification law created?

Today, some retailers in the beauty sector do not hesitate to use cash register software that allows them to hide part of the receipts to avoid paying part of the VAT. In order to fight against this VAT fraud, the 2016 finance law has introduced the obligation to use NF525 certified cash register software from 2018. In case of control, the absence of a certificate proving that the cash register software meets the certification will be subject to a fine of 7,500 euros.

How can I avoid being sanctioned as of January 1, 2018?

According to article 88 of the 2016 finance law, as a VAT taxable person and a computerized merchant you can prove in two ways that you are not defrauding :

• Either the software or cash register system is certified by AFNOR
• Either you present an individual certificate from the software or cash register system manufacturer certifying compliance with the conditions. If you are unable to prove that the software or cash register system complies with the standards in force, you may be liable to a fine of 7,500 euros and have 60 days to rectify the situation.
